Sec. 3-2. Posting
generally. |

|
|
It shall be
unlawful for any person to post, tack, nail, attach or in any
other manner fasten bills, circulars, posters, notices, papers,
or other advertising matter of any description to any pole,
tree, structure or any other property, public or private,
without the written consent of the owner or occupant of such
property.

Sec. 3-3. Posting of
legal notices. |

|
|
|
|
|
Nothing contained
in section 3-2 of this chapter shall be construed to prohibit
the posting of legal notices by public officers in the
performance of a public duty in the manner and in the places
prescribed by law or ordinance.

Sec. 3-4. Marking on
streets or sidewalks prohibited. |
|
|
|
|
|
|
|
|
It shall be
unlawful for any person to advertise, or attempt to advertise,
by marking or painting on any of the streets or sidewalks within
the city.

Sec. 3-5. Placement of
signs in right-of-way for civic or nonprofit events. |
|
|
|
|
|
|
|
|
Signs, banners,
billboards and similar structures and objects directly relating
to charitable, historical, religious or other civic services and
nonprofit activities may be installed in the public
rights-of-way upon a permit issued by the permits and
inspections division of the public safety department.

Sec. 3-6. Destroying
lawful posters. |
|
|
|
|
|
|
|
|
It shall be
unlawful for any person to wrongfully and maliciously tear down,
deface or cover up any posted advertisement or bill of any
person when the same is lawfully posted and put up and during
the time such sign or advertisement shall be of value.

Sec. 3-7. Attaching
stickers to vehicles. |

|
|
|
|
|
|
It shall be
unlawful for any person to attach any gummed sticker to any
vehicle within the city without the consent of the owner of such
vehicle.

Sec. 3-8. Misleading and
untrue statements. |
|
|
|
|
|
|
|
|
It shall be
unlawful for any person to make any statement or assertion in
the city, in any newspaper or other periodical or by public
advertisements or by letter or circular or by sign or display
card, or in any other manner or by any other means, directly or
indirectly, concerning the quality, quantity, value, price,
method of manufacture or producing of such merchandise or
professional work or the manner or source of purchase of such
merchandise, or the name under which the store, business or
profession is conducted, or the purpose of any sale, which is
untrue or calculated to mislead; provided, however, that this
section shall not be deemed to apply to newspapers in accepting
advertisements from advertisers, it being the purpose and intent
of this section to prohibit any person from falsely or
deceitfully advertising any business or profession and not to
regulate the business of newspaper advertisements.
